Why DNC & Litigator Screening Is a Must for Real Estate Texting
Published March 11, 2026 ยท Last updated: March 11, 2026
If you're texting real estate leads through Follow Up Boss, you're probably focused on speed and consistency. But there's a risk most agents don't think about until it's too late: texting someone on the Do Not Call list โ or worse, a known TCPA litigator.

0:00One text to the wrong number can turn into a TCPA lawsuit. That's why SendMate adds DNC and litigator screening to your Follow Up Boss text follow-up, before a single real estate text goes out.
0:12There's an entire industry of serial plaintiffs who stay on the Do Not Call list, sign up for lead forms, and then sue agents who text them. In Follow Up Boss they look like any other real estate lead, and by the time you notice, the text is already sent.
0:27SendMate screens every phone number against Federal Do Not Call, State Do Not Call, the DMA opt-out list, and known TCPA litigators. It also detects the phone type, so landlines that can't receive texts turn into a call reminder instead.
0:44As your Follow Up Boss tasks load into SendMate, flagged contacts get a clear badge โ litigator, DNC, or DMA โ so you see exactly why a number was flagged before you decide. Results are cached, so you're never charged twice for the same number.
1:00This is automated follow-up texting, but never an unattended blast โ you set what happens for each flag. Skip texting for litigators, flag-only for established clients who may still qualify under the existing-relationship exemption, and every reply lands right back in Follow Up Boss.
1:18Texting Betty, Lead Engage, Agent Legend, and Street Text send through third-party numbers with no visibility into who's on a Do Not Call list. SendMate is local-first and sends real estate texts from your own number, so you get compliance visibility other Follow Up Boss texting tools simply don't offer.
1:37Connect once with your Follow Up Boss API key, turn on DNC screening, and every real estate text is checked before it sends. Get DNC and litigator screening for your Follow Up Boss texting at MySendMate.com.
The Real Cost of One Bad Text
The Telephone Consumer Protection Act (TCPA) allows individuals to sue for $500 to $1,500 per unsolicited text message. That's not per campaign. That's per text. And there's an entire industry of "serial plaintiffs" โ people who intentionally stay on the DNC list, sign up for lead gen forms, and then sue every agent who texts them.
These aren't hypothetical scenarios. Real estate agents across the country have been hit with TCPA lawsuits from litigators who appear in their CRM as legitimate leads. By the time you realize what happened, you've already sent the text.
What Gets Checked
SendMate integrates with RealPhoneValidation to screen every phone number before a text is sent. A single lookup checks five things at once:
- Federal Do-Not-Call โ the national DNC registry maintained by the FTC
- State Do-Not-Call โ state-level DNC lists (rules vary by state)
- DMA Opt-Out โ the Direct Marketing Association's opt-out list
- Known TCPA Litigators โ serial plaintiffs and law firms that file TCPA suits
- Phone Type โ mobile, landline, or VoIP (landlines can't receive texts)
All five checks happen in a single API call. Results are cached so you're never charged twice for the same number.
How It Works in SendMate
When you enable DNC screening in Settings, SendMate checks each phone number as your tasks load. Flagged contacts get a visible badge on your dashboard โ Litigator (red), DNC (orange), or DMA (yellow) โ so you can see exactly why a contact was flagged before deciding what to do.
You control the action for each flag type independently:
- Skip Texting โ SendMate won't send to this contact (recommended for litigators)
- Flag Only โ the badge appears but sending continues (good for established clients who may be on the DNC list)
- Ignore โ no badge, no action (use with caution)
The Established Client Exemption
Here's the nuance that matters for real estate: if you have an existing business relationship with a contact, you may be exempt from DNC restrictions. This is why SendMate defaults to "Flag Only" for Federal DNC, State DNC, and DMA โ your FUB contacts are people you already work with.
Past clients, active leads, and anyone you have a prior relationship with often qualify for this exemption. But known TCPA litigators are a different story โ the legal risk is too high regardless of your relationship. That's why litigators default to "Skip Texting."
Always consult your compliance advisor for guidance specific to your market and business.
What About Teams?
For teams using SendMate, the team owner can share their RealPhoneValidation API key with all members. Cached results are shared across the team โ so if one agent looks up a number, every team member benefits from that lookup without being charged again. Each member still controls their own flag actions independently.
An Integration, Not a Built-In Service
DNC screening is an optional integration powered by RealPhoneValidation. You bring your own API key, and lookups are billed directly by RealPhoneValidation at $0.02 per lookup โ no markup, no monthly minimums. SendMate provides the integration, the caching layer, and the in-app controls. The screening data comes from RealPhoneValidation's database.
Cached results are configurable from 1 to 12 months, so you're not paying to re-check the same numbers every time your tasks refresh.
Why No Other FUB Texting Tool Offers This
None of the other FUB texting tools โ Texting Betty, Lead Engage, Agent Legend, or Street Text โ offer DNC or litigator screening. They send your texts through third-party numbers with no visibility into whether the recipient is on a DNC list or is a known litigator. You're flying blind.
SendMate is the only assisted texting tool for Follow Up Boss that gives you this level of compliance visibility before a single text goes out.
The Bottom Line
TCPA lawsuits are real, expensive, and preventable. For $0.02 per lookup โ cached so you only pay once per number โ you get peace of mind that every text you send has been screened against federal, state, and litigator databases. It's a small price compared to a $1,500 per-text penalty.
Enable DNC screening in SendMate Settings to get started. All you need is a RealPhoneValidation API key and a SAN number from telemarketing.donotcall.gov.
